Our total liability to you for any claim related to the Services will not exceed the greater of $100 or the total amount paid by you to us in the 12 months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Core Group Advisors, its affiliates, and their officers, employees, and agents from and against any claims, damages, liabilities, and expenses arising from your use of the Services or violation of these Terms.
Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules. Any disputes will be resolved in the state or federal courts located in Kent County, Michigan, unless resolved through arbitration as outlined below.
Arbitration Agreement and Class Action Waiver
Any dispute or claim arising out of or relating to these Terms or the Services will be resolved through binding arbitration conducted in Kent County, Michigan, in accordance with the rules of the American Arbitration Association (AAA).
- You agree to waive the right to a jury trial.
- You agree that disputes will be handled on an individual basis only, and not as part of a class, collective, or representative action.
- Either party may pursue a claim in small claims court in Kent County, Michigan, if eligible.
Termination
We may suspend or terminate your access to the Services at any time if we reasonably believe you have violated these Terms. Provisions regarding intellectual property, indemnification, limitation of liability, and arbitration will survive termination.
Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on our website with the revised “Effective Date.” Continued use of the Services after updates are posted means you accept the changes.
